Epopea(blue) (923.3 days ago) You should def. do some calling around to various agencies that are designed just for that reason. Under the family leave act of 93 or is it 94, you are legally on a federal level guaranteed your same rate of pay, hours, benefits, and comperable job duties after maternity leave. The company cannot completley change your job description without consulting you first. There are three or four agencies that you can contact to help you sort out any problems and of course I am having pregnancy brain and cannot think of any to tell you. I would do a search online and look for any sites that are .gov or .edu domains. Good luck!!

ermsmom (925 days ago) I`m pretty sure it`s illegal to demote someone just for maternity leave. You should check the laws in your state and speak with your HR department.
pooka (925 days ago) but you can get more payed weeks if you ask your doctor to give you sick leave before you take your maternity time. You have received sickness benefits before or after your maternity benefits!
You could receive up to a maximum of 65 weeks of combined sickness, maternity and parental benefits instead of the normal combined maximum of 50 weeks. In order to be eligible for the increased number of weeks, the following conditions must be met during your benefit period:
* you have not been paid regular or fishing benefits ;
* you have been paid sickness, maternity and parental benefits; and
* you have been paid less than the maximum of 15 weeks of sickness benefits or less than 35 weeks of parental benefits. See examples.
pooka (925 days ago) Sorry I was meaning 52 weeks ... which is what your employer has to give you before they can give away your job .. not 54.. its unconnected with EI payments. I meant your payments are variable where you live. The $447 a week, there is a rate for people who live in specific areas that changes that a bit.
Peachy09 (Ashlyn) (925 days ago) I`m lucky theres not a lot of variability in my position so I didn`t have to worry about it, but here in the US I`m pretty sure you are allowed up to 12 weeks off with the promise of the same -or- equivalent position & pay. But you aren`t guaranteed pay while off or your exact position. Sucks...
butterblocksmom (925 days ago) Pooka....how did you get 4 extra paid EI weeks without it being holidays, medical or extended leave due to medical. Service Canada states 50 weeks under `normal` circumstances...15 maternity + 35 parental = 50 weeks. (I really want to know!! Maybe I am missing out on something!)

As far as i am aware, if you take the allowed time off (i think 6 weeks for vaginal delivery and 8 for c-section) then they have to offer you the same job back, unless they do a complete company re-org and eliminate your position completely. But i would def check the laws.

butterblocksmom (925.1 days ago) Ladobruk is right about labour laws here in Canada...but then again we can take up to 50 weeks off with pay (not much pay - upto $447 a week) so a lot can change after a year. I have always been a career girl...but then when I went back to work after baby #1 and got pregnant with baby #2 I realized I WANTED something different, I wasn`t content to work my butt off anymore...coming home by 3 to pick up my son was WAY more important to me. Although you have a right to feel mad (everything is so unknown right now), wait until you are back at work before deciding what you really want out of work. If it is same pay and less responsibility...that`s not necessarily a bad thing. We don`t know what we don`t know...so take it one day at a time and if you simply aren`t satisfied....have a discussion with him.
RobinG (925.1 days ago) In my sisters case it was a company wide modification so it doesnt apply to being required to giving you the same position. If it is just you yes but if it is many being switched around it is allowable as long as your income isnt decreased ~
juels101 (925.1 days ago) At least in Canada (not sure where you live, didn`t check the profile) but they have no choice but to give you the exact job that you had, you can take it to the labor board and they will have to. You should just be able to bring that up to the scum bag, and it should be enough for him to know that you are aware of your rights. If not I would certainly take action and make sure he can`t get away with it
RobinG (925.2 days ago) My bosses were great with my frist. My sister was out for a long time for chemo and they made changes while she was gone and although hard it was things they had to do to keep things running smoothly. If the changes that are occuring would have happened anyhow whether you were pregnant or not then it is peace of mind knowing it isnt because of your pregnancy and not a punishment. As hard as it is, even though it feels like you are being punished a company has to make modifications for while you are gone to keep things going smoothly. They cant let you go because that is discrimination but being moved to a new position can occur since you arent there. It happened to my mom when she was having chemo and my sister with chemo. When I worked for an insurance company we got moved around alot and it was annoying at times and felt like a promotion one sec and a demotion the next but it was all just to keep things going the best way possible. Its usually all good :)
nmck (925.2 days ago) It was hard to go back after someone filled in for me. I mean getting my space back to my standards. But my boss and co-workers were very welcoming and supportive. They told me they really missed me and were thrilled to have me back.
