21-4-2009 - Legal Stuff...Help Please

So last night was the last straw between me and Jayde's father (Roland). For a little background...Roland and I have been off and on since June 2007 and I got pregnant in July 2008 (while we were off). We've tried and tried to work things out, but something always seems to go sour pretty quickly. But, since I started sleeping with Roland I haven't been with anyone else. Well, he has...he lied about two girls (not really cheating cuz we weren't together but we were still having sex) and cheated with another (we WERE together). Last night I found out again that he's been lying about this chick (he's actually in a RELATIONSHIP with her!). The last thing he told me was he was taking time for himself to become someone that was fit to marry me and for me to wait for him...waiting is what i've been doing and he's with someone else!

My questions are about court, custody, and child support. Obviously i dont feel i can trust him so i'm not letting him take her anywhere. I've told him he can see her, but only while i'm around (either in my apt. or i can bring her to him for a quick visit). He hasnt seen her in a week and a half but of course he's made time for his new girlfriend. I have saved all the proof of his dishonesty and cheating and the proof that i've paid for everything for Jayde thus far. He doesnt pay any child support because he doesnt have a job. He lives with his mom...so what do you ladies think?

If i take out child support will i get anything since he doesnt have a job? If i get child support wont he then have more rights to Jayde? What kind of custody or visitation would he get?

I'm so angry, hurt, and confused...I want Jayde to know and be around her father but I cant trust him AT ALL. I dont want to subject my daughter to a father who is gonna choose his chick over her or lie to her. What should I do? Any advice is welcome, thanks!

I live in MO and here a child support order does not award custody or visitation. Like the person before me said, the dad has to get a lawyer and file for custody and visitation. As far as I know, the dad is responsible for paying his child support whether he has a job or not. And I think when the guy gets 5,000 or more behind...they can be placed in jail for non-payment.
I know you're upset right now as you have every right to be but just because he is a liar and cheater that doesn't make him an incompetent father. Do you really think that he would do something to hurt the child?
Don't get me wrong, I feel you. I don't trust my child's father either. He is immature, irresponsible and makes stupid decisions so I do think he'll be taking my baby anywhere until the child is like 2. Plus quite frankly, I don't like the idea of him taking my baby around his little girlfriends. Is that what you're feeling too?

I live in NC and when it comes to child support, child support enforcement should gets things rolling for you. When it comes to custody and visitation, it will be his burden to take you to court for that. Most guys that don't have a job, probably won't do it because it costs $$ to hire a lawyer to go to court. So go for child support!! He needs to take care of his responsibilities!! Good Luck!!

It depends on your state. I know my dad was unemployed for a short period of time, in which case his child support was put on hold and when he got a job he owed more, and child support in general is base off how much you make. But I know some states will make it mandetory that they have a job, and they can get sent to jail if they don't have one.
As far as custody goes, mother almost always gets granted custody unless the judge has good reason not to give her custody. And for visitation it also depends on your state Im sure...in the case with my father and his exwife..she got to choose when and how often he saw their daughter. I would def. make it clear to the judge though that you don't trust him with your child.
