26-8-2009 - Parental Rights - Question...

My mood while writing this blog: ... sad ... as usual ...

Well, the law actually managed to catch my husband in a rather speedy time-frame this time...surprize! surprize! I say that because I filed "Contempt" papers on him, back on July 29th - went to court on the date my subpeona had ... only to waste time & pay 'cuz they informed me that he still hasn't been located & served. Well, we had another court date coming up and i just knew he'd show for that one, so I had him served with the contempt papers then. We also over-heard an officer tell him that he ALSO had another court hearing, in another court room?? Wow! Well, I can only assume that his public defender told him the same as ours ... that he'd be going to jail that day, as they intended to revoke his bond because he was recently charged with Felony Burglary, while out on bond!! Geesh! Looks like he's trying REAL HARD to earn visitation rights with his children, huh?! :o( Well, he didn't even stay for the court hearing - he fled, and a warrant was placed for his arrest. That was on the 19th - they caught up to him on the 23rd, and I learned about it on the 24th... he looks SO incredibly "messed-up" in the photo taken at the jail... apparently, he's turned VERY heavily to his addiction for help, rather than away from it, for some REAL help...

Anyway, I'm in a horrible financial spot because of him. I'm moving out of the home that I worked so hard for - the home he tried to destroy on so many occassions. And, I really just want to leave the state... with all the charges he currently has against him, it appears that he'll be gone away to prison for quite some years. I don't have family here, so why stay? I don't want my children anywhere near his family, and they haven't even called to talk to our child at all, so? I actually just PRAY that Karma catches up to them soon, as it will definitely OPEN the eyes of the legal system as to WHY I really don't want my children around them - Not Good! Let's just say that it is completely obvious where my spouse got all these issues :o( I'd like to break the cycle of severe dysfunction that runs in that family.

I believe that all the charges my husband has should actually make the courts want to terminate his parental rights - he has several of the offenses listed in the State code, any way. Is it difficult to have parental rights terminated under circumstances like this?? Everything states that what's in the child's best interest, is the key, and getting away from all of this IS in the BEST interest of my children... I just wonder how difficult it will be to actually have that granted? And, should he EVER get his life on-track, he should be able to re-gain his rights, correct??

Anyway, if anyone out there reads this and has advise or info ... PLEASE reply and explain all this to me - what I need to do, etc.
