08-12-2008 - Financial Woes

So I just feel like typing tonight apparently since this is my 3rd blog and I guess I just want to let everyone in on my business. LOL. I'm sure everyone has financial troubles from time-to-time and right now is a bad time for me, LOL. So here's my story financially. I filled Chapter 13 and consolidated all my bills nearly 5 years ago (I just call it my car payment since it's less than my car payment was and easier to say). It was definitely the best decision I've made I think.....So in September this was all suppose to be paid off based on the internet information from the Trustee's office and based on phone conversations I had with them over the last few months. So of course when it's paid off you don't keep paying. Well I called them a couple weeks ago to find out if the papers were in the mail for the case to be closed, and they were like ummm no you still owe us and in fact you are 2 months delinquent. And I was like...WHAT??? I called ya'll and looked on the internet. Well this is what happened the internet had an error. Originally my payments were set up at a lower amount but at the final hearing for court they upped my payment a little bit. Well the Trustee's office website never recalculated for the new payment amount so consiquently it looked like I was all paid up when in fact I still owe them $1537.00 and they want this money by January 19th...hahaha...NOT GONNA HAPPEN!!! So now they've filled a Motion to Dismiss my case and they said it will probably be no problem to get an extension based on circumstances but court date is January 28th....Now you tell me how I'm going to be in two different places 90 miles apart on that day...Since this baby is due on the 27th...again NOT GONNA HAPPEN!!! Who knows when he will decide to join us in the crazy world we live in but regardless this court date is way to close to my due date. So anyway I had to call my lawyer back to get her to working on the case again after nearly 5 years and who knows if she is going to want money or what.....I have no money to give her. I just spent $788.11 on car repairs (fuel pump went out so they replaced the pump/filter/spark plugs) My son's birthday was last month and then Thanksgiving and now Christmas and looking at 3 weeks off work no pay, then 80% short term disability after that for maternity leave. I can't pay anyone right now. I still don't have all the necessities for the baby...like a car seat in particular. And I hate to be picky on those but they are not meant to be hand-me-downs and I will only use one that is brand new. Car Seats are very dangerous as hand-me-downs and I just wont take that risk. If anyone is curious as to why I say that (I'm a cop on the side of my normal job and this info comes from car accident investigations) You never know what damage the car seat may have due to normal wear and tear and if you expect it to hold up in a car wreck you should know what all the car seat has been through...example: previous car wreck, dropped on the groung. banged around in storage....ect... Anyway that's my sob story on financial issues....I'm sure I could go into more detail but that is the highlight of the story.

I think your lawyer will easily be able to move the case. But why can't you just set up a new payment plan to pay off the rest instead of having to go back to court???? Even if you make small payments, you're still paying right???

Sound's like BD better kick in and buy the baby something or you'd better look into child support. I know that makes relationships tense, beleive me, I know. BUT that's your son's money, not yours or BD's. It's part of what he is entiltled to b/c you guys are bringing him into the world. =)
