04-9-2008 - I took my ex back to court today- here are the results

I was so nervous when I arrived in court this morning. I knew that I was on his territory (his town where he grew up- his family owns this town) so I had no idea how it was going to go today. Well I noticed that my ex was there with his mom, his wife and some other female. I did not see a lawyer- ummm i was some what confused. So we got before the judge and the judge noticed as well that he didnt have a lawyer. Infact he preached to him for over 10 minutes informing him about his bad judgement of not having a lawyer. The judge was like " That was a not a wise decision to not have an attorney, I dont care if you know the law you shouldn't try to defend yourself. Its going to be difficult for you to do opening and closing arguments by yourself. I suggest you try to get an attorney" im thinking shut up already, i rather him not get a lawyer so maybe he has less of a chance. Well it went great on our defense. I never noticed it before about my ex, but I now really realized where my child gets his learning disabilities. I kind of felt bad for my ex, he was having such a difficult time answering questions and understanding what my lawyer was asking him. He looked so confused and it made me want to get my child even more help b/c my ex didnt receive that extra learning help. See his father acted macho just like he does today. My ex's father prob denied that his son had learnig problems just like my ex is doing with my son now. Then I came back to reality and realized why we are court. My lawyer started suggesting to the judge that until his father realized how to deal with my son's handicap that he shouldnt use corporal punishment since it was very confusing for my son. So I really shocked my ex (and his family) when I got on the stand. My lawyer asked me if I wanted my ex's rights revoked. I said absoutely not, I WANT him to be involved. I want my child to have a relationship with his father. I dont want to take him out of his life I only want whats best for my son. I want him to stop beating my child. I dont want him to be abusive towards him anymore. All their mouths dropped b/c they were EXPECTING me to badmouth him. Then I said I also think that both families need to go to these parenting classes so all of us (grandparents, parents, step parents) know how to deal with my son's mental disabilities. I agreed that we should all benefit from this type of counseling. Another shocker to my ex that i was being so nice, and agreeing that we all got involved. Which later afterwards my lawyer commeded me about how mature I was about the whole ordeal and even w/ the abuse my ex was giving my son that I still continued to think that he should be involved in his life and it showed the court that I was the better person today. I told him well its true I want my son to be involved with his father, I just want him to be safe while he's doing it.Then my lawyer said something that really hit me hard b/c i been only thinking about the present and not the future. He said OK joshua is 10 and a mind of a 6 yr old. What about when he is 16, 18, 20 and mind set at 10 or 12? You think you have problems now? This is only the beginning, What about when he's going through the hormones and his body is older then his mind and he is confused about what is happening to him, Im like OH MY GOD, you are so right. What are we going to do? we need help now getting him prepared to face the obstacles that are ahead. It really got me thinking. So now back to court: What my lawyer said that it went in our favor that the judge ordered this case to be turned over to juvenile court (it showed the judge realized there was a problem that even HE couldnt resolve) They are going to do some investigation to see where the parents were at about the abuse and belt beatings. The judge said that the court will appoint someone for my childs defense (like a childs advocate or something) im like THANK GOD- finally someone to help my child... So the temporary order is as follows My ex has to give joshua his meds- (oh by the way my ex made the mistake of admiting that he doesnt give my son his meds on saturdays -ADHD pill- b/c he wants him to be a kid and not a zombie- which btw these meds help him to be able to have a conversation and understand what he's saying and helps him function daily) the judge told my ex that it is child abuse to NOT give your child a prescribed medication even if its your opinion as a parent to NOT give them the meds its abuse for him to not have my son take it. WHOO HOO judge!!! Yeah! Second order: He is not allowed to have anyone to smoke around him again. (for the last 10 yrs its been told to my ex by my childs dr that he is allergic to ciggerette smoke and to not smoke around him, which they have ignored and done anyway. Its a heredity allergy, my mother, myself, and both my kids have it- been diagnosed for all the ones that say you cant be allergic to cigg smoke) So YEAH he wont be around nasty smoke anymore. Then the judge's third order: that I am to have (YES) telephone contact with my child anytime I want to talk to him. (whoop whoop) He said that there is no reason why this mother can not talk to her child, and she has every right to be assured that her child is ok. OMG i couldnt believe this was going our way so far. Finally the last order: He said that my ex is to NOT physically punish my child. NO spankings at all. If he gets in trouble to put him in a corner (which is what works for son anyways) and to keep his hands off my child. YEAH YEAH YEAH YEAH I am so happy, I am so happy. Finally my child can begin the process of getting over and dealing with the abuse that was given to him from his father. he can stop being scared, if he complies with the order that is. I have joshua in counseling to help him get through this. GOD was on our side and I am so thankful for everyone's prayers out there. Thank you , thank you. Now the next step is juvenile court and lets pray that we will have similiar results.

I just wanted to say that you are probably a bigger person that I would be. If I found out my child was being abused by their father I would probably be demanding no contact and possibly castration!!!
So glad that things went your way today and I have my fingers crossed for you that the Juvenile Court goes the same way too.
