03-11-2009 - child support court was GOOD to me! comfortableMy mood while writing this blog:
comfortable

I had my 2nd court date today for child support (the first one ended in continuation b/c he had a doctor's note keeping him out of work). Well, I was kinda PO'd about going cuz I had to take a whole day off work and I used almost all my days for maternity leave last year, so I want to save as many as possible. Anyways I go in (at least Rol was on time today) and wait and wait. Finally, the case worker speaks to us both and Rol does admit he went back to work. I simply stated that everything was the same except childcare was more expensive (b/c I switched babysitters). So we wait some more and she calls us back out to break down what she will present to the judge. This is it: he supposedly makes 8.25 and works 20 hours a week, but she imputed him a part time job at minimum wage for his other 20 hours (basically he needs to be working 40 hrs. a week so she is saying he can find a part time job at minimum wage to make up the other 20 hrs....she includes the part time earnings he needs to go out and find in his income). She looked at my income which is pretty good and also put in that I pay Jayde's health insurance and childcare...his child support came to $354 a month!!!!! I know that might not seem like a while lot to some of you, but yall, I was really only seeking $100-$150 monthly, so I was sooooo shocked!

Anyways, we go in front of the judge and of course Rol speaks his mind b/c he thinks the amount is crazy high (he expects us to believe he doesn't even make that much). Yall, this boy's momma was even in the courtroom trying to speak and the judge shut her up real quick (cuz she's not part of the proceedings). But, the judge told us we couldn't do the imputing part (cuz he hadn't had time to look for a part time job), so his payment is $229 monthly (still more than I expected or even desired). Well, it got signed in and he owes it to me NOW and it's late after Nov. 25. It will be taken directly from his paycheck so there's no funny business that can take place. Tell me why though his mom was asking how to get it lowered once he goes back to school and if he could not be responsible for past medical bills cuz they were incrued before the childsupport order...whatever lady, complain and try to get out of it all you want...i doubt it's gonna work! But yall what kind of WOMAN would help in the hindering of another woman and her child???!!

So, there ya go...I'm happy! And, Jayde and I will be real comfortable in the coming months. We even go back in January cuz the judge says he needs to find a part time job so she can INCREASE the child support order, wow! I just wanna remind all of you that in July before I even went to the child support office I asked Rol and his mom if they could just commit to something like $100 a month or even just material items every month (like diapers, wipes, food, etc.). Well, they refused and laughed and said, "go ahead and take it to court...you won't get that much anyways." Well, GOD DON'T LIKE UGLY!!! I kinda feel bad cuz I know they don't have the best finanacial situation either, but I did try to be reasonable and they wouldn't budge. In the best interest of Jayde I did what I should have.

Well ladies, if you haven't taken things to the legal level, I would say DO IT! Even if you don't REALLY need it, put it in a savings account; none of us will ever be able to fund our child's college education, so think ahead! I know I'm taking $100 of my child support and putting it straight into a savings account. The way I figure it...100 a month for 17 years...that's over $20,000. That's at least 1 or 2 years of college! So, yeah, I'm glad it's done and I can stop asking him for money or materials. Now, the only thing I need to talk to him for is if he wants to see Jayde.

Tomorrow's Hump Day!!! :)

I just read your blog and go for you. I child father is is a fire fighter and he makes 120,000 a year. In the state of California you get 20% of whatever he makes plus an additional percentage if he does not see he child and childcare of top of it. I told him that I wanted to work things out with him regarding child support and care but he did not want to do it. Now he wants to work it out and I told him no. I said I gave him an opportunity to work it out and am a woman of my word when I said that I was going to take him to court. When you tell somebody something you have to stick to it and not go back on what you say because they will run over you. Sean is going to be really sad when our daughter start going to private school. We will see because he has come around a little. The support is for the child and I am glad that you realize it. So many woman don't go after child support for stupid reasons. We have to think about the children since the men don't think about the children we as woman have to think about our children.

Go head girl! I love to hear stories like this. I can't believe that granma didn't want him to be responsible for just 100 a month. That's why he's so ireesponsible now. Jayde deserves every single penny, so don't start to feel guilty in the coming months because they'll try to make you feel like you're doing something wrong. He needs to get a FT job anyways. The bible says that the man who doesn't work doesn't eat!

I think it's good that the court ordered a child support agreement against a man who doesn't want to take care of his child. I personally don't agree with child support courts because most of the time they go off of a calculator and don't take personal decisions into play. I know a man who is married with two kids and they make him pay 400 to his other child. Him, his wife and two kids are on section 8 and have to use food stams and other government assistance because he can't afford to take care of them now. I don't use that much to take care of my son. My son wears name brand clothes and Pampers, nothing knock off. It only costs me for daycare and my son's father pays that since I have my son full time. Thank God for stand up fathers!!! I need to thank God and my son's father more often because I would hate to be in a situation where I wouldn't have enough to provide for my child. God bless to you!!!

Congrats! I am still waiting for my child support order to go through and my son's father owes me like $40,000 as of now. He has been just moving and lives in other states so who knows. It would be nice for that extra help and like you said for our children's future. These men are so selfish and for his mother to support that is absolutely ridiculous. Good for you!

NylahsMom - Wednesday, 4 Nov
That is great news girl.. these men need to take responsibility and contribute to taking care of their kids.. like it or not!! You did the right thing ... I swear its nothing good mother's wouldn't do for their kids. Oh and his momma that heffa know she wrong!! Teach your boys to be men.. if he can't afford the child support with his one job make his ass get another .. teach his as sresponsiblity... but since she can't the courts will..LOL!!

vickiessecret - Wednesday, 4 Nov
That's great, Good he should be giving you something. It's not fair to make you pay for everything. Hope all goes Well :)

I'm so happy for you! and that's what his butt get!

Icky! They sound so triflin! I'm glad you are getting your support, you deserve it. I knew a girl who did the exact same thing, she just wanted a little help with her two girls. I think she asked her ex for like 200 bucks a month, and he wouldn't do it. She went to court and he was ordered to pay almost 500 a month! LOL, what is wrong with men these days? I'll tell you what it is, it's Mothers like your ex's. They make excuses for their loser sons, and treat them like they are a vicitm. So aggravating!! Glad it went well for you! xoxox
