A little over a month ago, I was unexpectedly laid off from my job. I was five and 1/2 months pregnant at the time. So anyway, I've been going on interviews trying to hide my stomach. I know for a fact that employers have passed over me for jobs because they saw that I was pregnant. It's illegal but there's really know way to prove it, just my intuition.
So anyway, fast forward. I was offered a job...a job making 10,000 more than my previous job. It was a social work position at a hospital so it came with good benefits and everything. I was so excited. I was scheduled to begin orientation on Monday but last Friday I got a call from Human Resources telling me to report to their office instead of going to orientation. My heart dropped. I had just recently informed my supervisor that I was 34 weeks pregnant and I knew something was up.
So I go in to meet with Human Resources. They tell me that there is an attendance policy in effect for the first 90 days of employment. They proceed to say that since I will need to take maternity leave within the first 90 days that I will be in violation of the attendance policy and would likely be terminated as I will not be eligible for FMLA and can not be approved for personal or medical leave until I have completed probation. (They tell me there is no way to alter the policy). I am told that if I am terminated due to attendance within the first 90 days that I will not be eligible for rehire for a year. They strongly advise me to decline the position in order to remain eligible for rehire. Human Resources tells me that once I have delivered the baby and can complete 90 days uninterupted, they will assist me in locating other positions. But I don't want another position, I want the position that I was offered. No woman should lose thier job or have to decline a position because they are pregnant. I consulted a lawyer but I was told that it is legal since I would in fact violate the attendance policy when I took maternity leave. This is some bulls*t...please share your thoughts

All of these work issues come at such a horrible time. I am still unemployed but am looking for work. I can't believe they will not alter the policy for you. Then they should have not accepted you. I don't think its fair to you and I am sorry you are dealing with that. I am looking at jobs outside of social work to take a break. I am going to go back into it after a few months but for me it is too stressful and I can't handle the hours and a new baby since this is my first. I wish you luck with the job stuff. You have dealt with a lot.
